DMCA Notice Submission

If you have reasonable belief that material made available on sites hosted through CTB Services infringe on your copyright(s), you may notify us by sending a DMCA notice. CTB Services complies with Digital Millennium Copyright Act and this page describes our policy and facilitates processing for DMCA notices.

When receiving a DMCA notice, CTB Services will:

  1. Review the notice submitted by the copyright holder.
  2. Notify the site owner and reply to the copyright holder that action is being taken.
  3. If the notice is complete and valid, we will remove the content. However, in many cases we may allow the site owner to respond or remove the content themselves.
  4. If the site owner believes they have rights to use the content or that the DMCA notice was submitted incorrectly by the complainant, the site owner may submit a counter notice. We will review the counter notice for completeness and provide notice to both the site owner and copyright holder, providing a copy of the counter notice to the copyright holder.
  5. If the site owner does not counter the DMCA notice, the submitted case is counted against their account standing.
  6. If the copyright holder doesn't take further legal action within 10 to 14 business days of the submission of a counter notice, the content may be restored by us if it was removed or no actions may be taken against the site owner.

Before sending a notice, please confirm that the site in question is indeed hosted by CTB Services. Additionally it is important to consider if the manner in which the material is used falls under Fair Use. You are required to consider the possible fair use implications, as a result of Lenz v. Universal. If you are not sure if the materials are indeed hosted through CTB Services, or are not sure if the materials are subject to fair use protections, you should consider seeking legal advice.

Be advised that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that materials or activities are infringing. We reserve the right to challenge abuses of the DMCA process, and your use of this form does not waive that right.

When filling a notice with CTB Services, you must follow these steps:

  1. Contact the site owner directly using contact information or forms available via their site and attempt to resolve the matter directly between you and the site owner.
  2. Verify the site is indeed hosted through CTB Services, and direct your complaints appropriately.
  3. If the issue cannot be resolved directly with the site owner, send your complaint using the form below.
  4. You must include the following in your message and if you fail to provide these we will not respond to your complaint:
    1. An electronic signature of the copyright owner or a person authorized to act on their behalf.
    2. An identification of the copyrighted work claimed to have been infringed.
    3. A description of the nature and exact location of the material you claim to infringe on your copyright, in sufficient detail to permit CTB Services to find and positively identify the material. Links exactly to the materials or pages on which the materials appear are required.
    4. Your name, address, telephone number, and email address
    5. A statement that you have a good faith belief that use of the materials identified are not authorized by the copyright owner, its agent, or the law.
    6. A statement that the information in your notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

As required by the DMCA, our policy is to terminate sites or customers that we consider to be repeat infringers. Our policy also stands to protect legitimate users from wrongful termination or abuses of DMCA against them. Notices that are successfully countered do not count against the site owner.











    Provide the exact location (a full URL) to the infringing material in question. Please submit only one notice per web page.

    Provide a description of the copyrighted work, so it may be easily identified.

    Provide the location of and proof of copyright for the original material.
